DEPOSIT: The purchaser shall at the time of auction pay a deposit of five percent (5%) of the highest bid and payable as follows: AGREEMENT: Immediately after the sale the purchaser shall sign a contract to complete the sale according to these terms. These conditions of sale shall be attached to and form part of the contract. AUCTION PREMIUM: The purchaser agrees to pay to Timewell Auctions a premium. The premium shall be two percent (2%) of the highest bid plus applicable taxes on such premium. The purchaser further as auctioneer shall be in addition to the highest bid. Provided that the purchaser has not given notice of objection in accordance with paragraph 6 ("Title Search"), the premium is payable and due on the closing date in accordance with paragraph 6. CLOSING DATE: The sale shall be completed within twenty (10) days thereafter, when the balance of said purchase money shall be paid. ADJUSTMENTS: All adjustments of insurance, rent, taxes, local improvement rates and other assessments to be apportioned to the date of completion of sale, when possession shall be given. INACCURACIES, ETC: The description and information respecting the property in the advertisements for sale are believed to be correct, but if any error be found therein it shall not annul the sale, nor shall any compensation be allowed in respect thereof. AS IS: The purchaser will accept the property on an "as is where is" basis as it exists on the date of closing without regard for, without limitation, its state of repair, defects in workmanship and location of structures. The Vendor makes no representations or warranties as to title or condition of any fixtures or chattels on the property. TITLE SEARCH: The purchaser shall not be entitled to any abstract or other evidence of title not in possession of the vendor, and shall make any objections to the title in writing to the vendors solicitor, SOFT CLOSE. In order to prevent sniping ( people tyring to win the bid by bidding at the last second) we offer a soft close. If there is a bid on an item during the last 3 minutes of bidding, it will force the bidding to remain open on this item for another 2 minutes. This will carry on until all bidding has closed.
